IS YOGA THE NEXT HOTBED OF LITIGATION?
We certainly hope not but with the ever increasing popularity of yoga it wouldn’t come as a surprise if we start seeing more law suits pop up across the country against teachers and studio owners. Those juicy adjustments most of us love so much (personally, I can’t get enough of ‘em when I’m in class) could create a professional liability suit against the teacher and the studio!
Yes, that’s correct, some of our fellow yogis and yoginis are filing lawsuits against our very own teachers. But, are they warranted claims? It all depends. If a teacher adjusts or manipulates you and that adjustment results in an injury from an incorrect adjustment, well then… But, wait, what about the fact you let them adjust you and didn’t waive them off or tell them to stop? Shouldn’t you know your own body and its limitations? And what if the teacher made an announcement in the beginning of class that if you don’t want an adjust to let them know if they approached you during class?
Of course, an incompetent teacher, and yes, with the ever increasing popularity of teacher trainings around the globe they are out there (that’s an entirely separate subject to discuss) are making incorrect adjustments that might result in injuries!
However, I personally don’t want to see our beautiful practice (and loving teachers) be exploited by attorneys and unneccesary lawsuits. After all, certain styles are very physical practices, and injuries can and will happen.
Personal Accountability can and must be maintained and discretion used wisely! After all it is yoga!!! Students, please remember the philosophy and tenants of yoga and make sure it is absolutely warranted before you file a frivilous suit! Teachers, please continue to give us those juicy adjustments we all love so much without fear of being sued. Just continue to use your discretion and knowledge to make correct and safe ones!
The last thing this yogi wants to see is more red tape, waivers, additional insurance underwriting, and paperwork clouding my practice of yoga in studios around the country. After all, every time we walk into the practice room don’t we understand that injury is a possibility albeit a small one!
